These Terms & Conditions ("Terms") govern your use of this website (the "Site") and any purchase of products from Zygo Health Ltd ("we", "us", "our"). By using the Site or placing an order, you agree to these Terms.

2) Definitions

  • Consumer: an individual acting for purposes wholly or mainly outside their trade, business, craft, or
    profession.
  • Business Day: a day other than a Saturday, Sunday, or public holiday in England.
  • Subscription: an automatically renewing purchase at the frequency shown at checkout.
  • Products: the items we sell on the Site.

3) Important product notice (food supplements)

Our products are food supplements and are not medicines. They are not intended to diagnose, treat, cure, or prevent any disease. All information on the Site (including product pages, articles, FAQs, and customer support responses) is for general information only and is not medical advice.

You should:

  • Always follow label directions.
  • Check ingredients for allergens and suitability before use.
  • Speak with a qualified healthcare professional before use if you are pregnant, breastfeeding, trying to conceive, taking medication, have a medical condition, or are under medical supervision.
  • Stop use and seek medical advice if you experience an adverse reaction.

Customer responsibility: You are responsible for determining whether a product is suitable for you and forchecking the label and ingredients. Individual results vary and we do not guarantee specific outcomes.

4) Eligibility and permitted use

By placing an order, you confirm that you are legally capable of entering into a contract and you are purchasing for personal use and not for resale unless we agree otherwise in writing.

We may refuse or cancel orders we reasonably believe are placed for resale or commercial distribution.

5) Orders and contract formation

  • When you place an order, you are making an offer to buy the Product(s).
  • An order confirmation email confirms we received your order but does not mean your order has been
    accepted.
  • A contract is formed only when we dispatch your order (or otherwise confirm acceptance).
  • We may refuse or cancel an order if, for example, there is a pricing/stock error, suspected fraud, or we cannot deliver to your address. If we cancel after taking payment, we will refund you.

6) Prices, payment, and promotions

  • Prices are in GBP (£).
  • Payment is taken at the time you place your order (including subscription orders).
  • Promotion codes must be applied at checkout and cannot be applied retrospectively.

6.1 Promotions and discount codes (formal)

  • Discount codes are non-transferable and have no cash alternative.
  • Codes may not be combined ("stacked").
  • We may withdraw, suspend, or amend promotions at any time for future orders.
  • We may refuse to honour a promotion where we reasonably suspect misuse, fraud, or breach of these Terms.
  • Where a promotion, discount, or code has separate terms, those terms apply and will prevail to the extent of any inconsistency with these Terms.
  • If we discover a pricing mistake, we may contact you to confirm whether you wish to proceed at the correct price or cancel for a full refund.

7) Delivery

7.1 Delivery areas and times

We deliver to UK addresses and we may offer overseas/international shipping to selected destinations at an additional cost. Where overseas shipping is available, options and pricing will be shown at checkout. If overseas shipping is not available for your destination (or the cost is not shown at checkout), contact us at hello@zygohealth.co.uk for a quote and availability.

Delivery estimates shown at checkout are estimates, not guarantees. We are not responsible for delays outside our control (e.g., carrier disruption, customs processing, weather, strikes, system outages, or incorrect address details).

7.2 Free shipping

We currently offer free shipping on eligible UK orders (as displayed at checkout). We may change this offer for future orders.

7.3 Delivery address accuracy
You are responsible for providing a complete and accurate delivery address and access information. If an order is returned to us because the address was incomplete/incorrect or delivery could not be completed, we may (at your option):

  • Re-ship the order (you may need to pay re-shipping costs), or
  • Refund you minus any costs we incur for return shipping/handling (where permitted by law).

7.4 Safe place instructions

If you ask the carrier to leave your parcel in a "safe place" (where supported), you accept responsibility for loss or damage after delivery.

7.5 Risk and ownership

  • Risk of loss or damage passes to you when you (or a person/carrier you nominate) take physical possession of the goods.
  • Ownership ("title") passes to you once we have received payment in full.

8) If your order arrives damaged, incorrect, or missing items

If your order arrives damaged, incorrect, or with missing items, email hello@zygohealth.co.uk and include your order number, photos of the outer packaging, inner packaging, product(s), and shipping label, and a brief description of the issue.

8.1 Reporting window (72 hours)

Please report damage, missing items, or incorrect items within 72 hours of delivery. This helps us investigate quickly and raise claims with the carrier where relevant. We may not be able to offer a replacement or swap if you report outside this timeframe where permitted by law.

8.2 Swaps/replacements

Where appropriate, we will arrange a replacement/swap or another suitable remedy. We may request that the affected item(s) be returned before issuing a replacement.

9) Statutory cancellation rights (online purchases)

If you are a Consumer, you may have statutory cancellation rights for online purchases.

To request cancellation, email hello@zygohealth.co.uk with your order number and a clear statement that you wish to cancel.

9.1 Sealed goods and hygiene/safety exception

Because our products are ingestible and supplied in sealed packaging, we cannot accept returns of any product that has been unsealed after delivery, for health protection and hygiene reasons.

That means:

  • Unopened/sealed items may be eligible for return where cancellation rights apply (subject to the return process below); and
  • Opened/unsealed items are not returnable, unless the product is faulty or incorrect.

9.2 Return process and timelines

Where a return is permitted under statutory cancellation rights:

  • You must return the goods promptly and within the timeframe required by law following the instructions we provide.
  • You are responsible for return postage unless we tell you otherwise.
  • We recommend using a tracked service. You remain responsible for the parcel until it is received by us.

9.3 Refund timing

Where a refund is due, we will process it within the timeframe required by law, using the same payment method you used.

10) Returns, refunds, and your legal rights

10.1 No returns/refunds for opened ingestible products

Because our products are ingestible, we do not accept returns or refunds for any product that has been opened, unsealed, used, or partially used after delivery, except where the product is faulty or incorrect.

10.2 Returns accepted only if sealed AND resalable

Where a return is permitted (including under statutory cancellation rights), returns are accepted only if the Product is unopened and the seal is intact, and the Product is returned in a resalable condition.

Resalable condition means the Product and packaging are clean and intact, and not damaged or defaced.

This includes (without limitation) no marks, scuffs, scratches, dents, crushing, tears, stains, writing, label damage, adhesive residue, or other cosmetic damage to the Product or its packaging.10.3 Condition of returned goods

Returned goods must be unopened, unused, and in original sealed condition, and packaged securely for transit. We reserve the right to refuse a refund (or make a reasonable deduction where permitted by law) if returned goods are not in a resalable condition due to handling beyond what is necessary to check the item.

10.4 Returns inspection

All returns are subject to inspection on receipt. We may refuse a refund (or make a reasonable deduction from the refund amount, where permitted by law) if:

  • the Product is returned opened, unsealed, used, or partially used;
  • seals are broken or packaging is missing or materially damaged;
  • the Product is not in a resalable condition (including due to marks, scuffs, scratches, dents, crushing, tears, stains, writing, label damage, adhesive residue, or other cosmetic damage); or
  • the return does not follow the return instructions provided or the statutory return timeframe.

Where a Product is returned opened/unsealed and is not eligible for return due to health protection and hygiene reasons, we may return it to you at your cost (or, where return is not reasonably practicable, arrange secure disposal).

10.5 Return shipping costs

Unless the goods are faulty, damaged on arrival, or incorrect, you are responsible for the cost of return shipping. We recommend using a tracked service.

10.6 Faulty, damaged on arrival, or incorrect goods

Nothing in these Terms affects your statutory rights. If goods are faulty, damaged on arrival, or incorrect, we will offer an appropriate remedy in line with consumer law.

For damage on arrival, missing items, or incorrect items, you must notify us within 72 hours of delivery in accordance with Section 8 (where permitted by law).

10.7 Orders cannot be "cancelled in transit"

Once an order has been dispatched, we cannot cancel it in transit. Any refund eligibility after dispatch is limited to returns of sealed/unopened goods where statutory cancellation rights apply and/or faulty,
damaged on arrival, or incorrect goods.

11) Subscriptions (cancel anytime, pause anytime, defer anytime)

If you purchase a Subscription: it renews automatically at the frequency shown at checkout unless you cancel, and you can cancel, pause, or defer at any time by emailing hello@zygohealth.co.uk (or via your account if available).

11.1 Changes apply to future shipments

Cancellation, pausing, or deferring applies to future orders. If an order has already been processed or dispatched, changes apply to the next cycle (unless the current order qualifies for return under Section 9
and remains sealed/unopened).

11.2 Operational cut-off

To ensure changes apply to your next shipment, you must request changes before your next billing/processing date shown in your subscription confirmation or account, and in any event no later than 3 Business Days before the next scheduled dispatch/charge.

11.3 Subscription price changes

We may change subscription pricing with prior notice. If you do not wish to accept the new price, you may cancel before it takes effect.

11.4 Failed payments

If a Subscription payment fails, we may retry your payment method and/or pause the Subscription until
payment is successfully completed.

12) Payment disputes and chargebacks

If you have an issue with an order, please contact us first at hello@zygohealth.co.uk so we can help. If a payment is reversed or disputed (for example, through a chargeback), we may pause fulfilment of any active subscription or pending orders until the dispute is resolved.

13) No resale / commercial use

Our products are sold for personal use only. We may refuse or cancel orders we reasonably believe are intended for resale or commercial distribution (including marketplace reselling) without our written
consent.

14) Product information

We aim to ensure product descriptions, images, ingredient lists, and other content are accurate. However, images are for illustration only, packaging and labels may vary slightly, and you should always read the label and instructions provided with the product.

15) Acceptable use of the Site

You agree not to misuse the Site (including introducing viruses, attempting unauthorised access, or scraping/reproducing content for commercial use). We may restrict access where we reasonably believe there has been misuse.

16) Reviews and user-generated content

16.1 Your content

If you submit or post any content on the Site or via our channels (including reviews, testimonials, photos, videos, comments, or other material) ("User Content"), you confirm that you own the User Content or have all necessary rights and permissions to submit it; it is accurate and not misleading; it does not infringe any third-party rights; and it is not unlawful, defamatory, abusive, discriminatory, obscene, or otherwise
harmful.

16.2 Licence to use reviews and testimonials

By submitting User Content, you grant us a worldwide, royalty-free, perpetual, irrevocable, non-exclusive, transferable, sublicensable licence to use, reproduce, publish, translate, distribute, display, edit (for length/clarity while preserving meaning), and create derivative works from your User Content in any media, for the purposes of operating, promoting, and improving our business and products (including on the Site, email, social media, paid advertising, and packaging). Where we edit User Content, we will not change the overall sentiment or meaning.

16.3 Moderation and removal

We may (but are not obliged to) monitor, moderate, edit, reject, or remove User Content at any time, including where we reasonably believe it breaches these Terms; is spam, fake, or inappropriate; or may expose us or others to legal or regulatory risk. We are not responsible for User Content posted by third parties.

16.4 No obligation to publish

We are under no obligation to publish User Content, and publication is at our discretion.

16.5 Incentivised reviews

If you received an incentive (such as a discount, free product, or entry into a promotion) in exchange for a review, you must clearly disclose this.

17) Intellectual property

All Site content (including branding, text, images, graphics, and product descriptions) is owned by or licensed to us and protected by intellectual property laws. You may not use it without our permission, except for personal, non-commercial use.

18) Liability

18.1 Non-excludable liability

Nothing in these Terms limits or excludes our liability for death or personal injury caused by our negligence; fraud or fraudulent misrepresentation; or any other liability that cannot be excluded or limited under applicable law.

18.2 No medical advice; suitability responsibility

All Site information is general and not medical advice. You are responsible for determining suitability, checking ingredients/allergens/contraindications, and following label directions.

18.3 Excluded losses

To the maximum extent permitted by law, we are not liable for: any indirect, special, incidental, or consequential losses; loss of profits, revenue, business, goodwill, opportunity, anticipated savings, or data; losses arising from inaccurate delivery details or carrier instructions (including "safe place"); delays or non- delivery caused by events outside our reasonable control (including carrier disruption and customs processing); allergic reactions or adverse effects where label directions were not followed or ingredient/allergen information was not checked; and minor differences in packaging or appearance that do not affect the product's core characteristics.

18.4 Liability cap

Subject to Section 18.1, our total liability for any claim connected to an order is limited to the total amount you actually paid for the relevant order.

18.5 Notice requirement (recommended)

You must notify us of any issue with your order within a reasonable time and in any event within 30 days of delivery (or, for hidden issues, within 30 days of discovery). Delays may affect our ability to investigate and may limit remedies where permitted by law.

18.6 Mitigation

You agree to take reasonable steps to minimise loss or damage. We are not responsible for losses that could have been avoided by taking reasonable steps.

19) Events outside our control

We are not responsible for delays/failures caused by events outside our reasonable control (including carrier network disruption, customs delays, strikes, extreme weather, system outages, warehouse disruption, or supply issues). We will take reasonable steps to minimise disruption.

20) Privacy and cookies

Your personal data is handled in accordance with our Privacy Policy and Cookies Policy (available on the Site). Transactional communications (order confirmations, shipping updates, service messages) are necessary to fulfil your order.

21) Communications and notices

  • We may contact you by email using the address provided at checkout/account registration. You are responsible for keeping your email address accurate.
  • A notice sent by email is treated as received at the time it is sent, unless we receive a delivery failure message.

22) General legal terms

22.1 Assignment

We may transfer (assign) our rights and obligations under these Terms to another organisation. We will notify you if this happens and it will not affect your rights. You may not transfer your rights or obligations without our written consent.

22.2 Severability

If any part of these Terms is found unlawful, invalid, or unenforceable, the rest will remain in full force.

22.3 Waiver

If we do not enforce any part of these Terms, it does not mean we waive our right to enforce it later.

22.4 Third party rights

No one other than you and us has any rights under these Terms (for the purposes of the Contracts (Rights of Third Parties) Act 1999).

22.5 Entire agreement

These Terms constitute the entire agreement between you and us regarding your use of the Site and your purchases, except where we expressly agree otherwise in writing.

23) Changes to these Terms

We may update these Terms from time to time. The version in force will be the one displayed on the Site at the time you place your order.

24) Governing law

These Terms are governed by the laws of England and Wales. Any disputes will be subject to the courts of England and Wales.
